Brian Hoeing & Jennifer Groves Fusco | State of Connecticut, Department of Public Health

Updike, Kelly, and Spellacy, P.C., is pleased to announce a favorable result for Attorneys Brian Hoeing and Jennifer Groves Fusco in successfully defending a physician before the State of Connecticut, Department of Public Health (“DPH”).  Pursuant to General Statutes § 19a-14, DPH is responsible for handling petitions against regulated health professionals.  In 2019, a UKS client was informed that a former patient had sadly committed suicide after many years of treatment for a complicated constellation of symptoms and health concerns.  The decedent’s family filed a DPH complaint asserting mistakes by the doctor, who immediately turned to UKS for representation.  Attorneys Hoeing and Fusco responded comprehensively to all DPH inquiries and advocated for their client’s full exoneration, utilizing UKS’ state-of-the-art cloud-based medical records collection and presentation techniques which proved particularly helpful during the COVID-19 crisis.  UKS recently received notice from DPH that its review of the doctor’s diagnosis, treatment and documentation resulted in a finding of no violations, thereby closing its investigation to the client’s most-welcomed satisfaction and relief.
