UKS Principal, Kevin J. McEleney, a member of the Firm’s Creditor’s Rights Practice Group recently gave a presentation to the Connecticut Bar Association’s Commercial Law & Bankruptcy Section on the somewhat obscure and technical subject of “hot goods” and asset liquidation under Article 9 of the Uniform Commercial Code. Kevin entertained and educated the Section gathering on how a large, commercial replevin action under State law relates to possible implications of Federal law regarding unpaid employee wages and benefits at the time of the replevin. Kevin explained how UKS successfully “threaded the needle” of maximizing the secured creditor client’s return on its collateral while at the same time observing Federal laws designed to protect employees compensation which relates to work performed in creating some of the goods that might have been involved in the replevin.
